1. Introduction
The Platform is a tool designed to help individuals and teams identify marketing capability strengths and weaknesses, support development and upskilling of individuals and/or teams in the area and industry of marketing and advertising. The Platform has been designed in consultation with industry , is grounded in industry research on current and future marketing capabilities and benchmarking requirements. (“Purpose”)


2. Registration
2.1 Instructions on how to register and/or use the ADMA Capability Compass (“Capability Compass” “tool”) forms part of these Terms of Use. Registration and participation is deemed acceptance of these Terms and Conditions of Use. These terms are subject to change as the Platform develops. The most recent version of the Terms and Conditions will apply.


2.2 Registration is open to all persons working in the field of marketing and/or advertising . Persons under the age of 18 must have parent or legal guardian permission to register;


2.3 There are two forms of registration available for this tool:


2.3.1 Individual registrations, where an individual registers directly through the official webpage made available by ADMA, they will be defined as an ‘individual registration’. It is up to the complete discretion of ADMA as to the timing of this method of registration; or


2.3.2 Corporate registrations, made available to Corporate Clients/ Organisations via an ADMA Account Manager and/or Corporate Client Partner. To use the tool under a ‘Corporate registration’ cohort, these registrations may only be made by a Corporate/ Organisation;


2.4 When an organisation chooses to register members of its team, its nominated representative (‘Enrolling Manager’) allocates the set number of registrations to specific team members. The Enrolling Manager provides the associated work email address for ADMA to send the invitations to participate. These team members can accept the invitation to proceed or choose to ignore the invitation.


2.5 In the event that a team member does not accept the invitation to proceed, then they will not be able to complete the Capability Compass assessment as registered by their Organisation. After a certain number of days (usually 30) after a registrants invitation has been sent, and has not been accepted, that registration will be considered to be ‘expired’. All persons who have for any reason whatsoever not accepted the invitation to proceed, will have their name sent to the Organisation and the Organisation may at the
complete discretion of ADMA
be able to transfer that allocated registration to another Team Member.


2.6 In the event that a User accepts the Enrolling Manager’s invitation to participate in the Capability Compass. That registration and all activity related to it will be included as part of that Organisation’s business cohort and associated registrations and activity within the Capability Compass.


2.7 All registrants will be allocated to the role of “Team Member” within the Capability Compass. This role allocation allows them to complete the ‘Individuals Capability Compass’ survey. In addition, an Organisation may choose to nominate certain registered users to take on the role of “Team leader “within the Capability Compass as well. This role allows the individual (in the capacity of Team Leader) to set priorities for their team. Please note that ‘Team Leaders’ are as allocated by an Organisation for the purpose of the Capability Compass and may have no reflection to a structure within an organisation.


2.8 The intention of setting priorities for their team is to identify capability development requirements for the specific team within the Organisation. This is to guide both individuals and teams to continue to improve in areas identified as a development opportunity to promote the further development of the individual, teams, business and industry as a whole.


2.9 Regardless of how the registration takes place, the Capability Compass Survey is conducted on an individual basis, with the results being derived based solely on the responses provided by each User during the evaluation/ question process. Once the answers are submitted at the “finish” prompt at the end (the green Finish button), the individuals Capability Compass survey generate a report for the individual which, if they have had a Team Leader set priorities for the team they are allocated to, will be mapped against those priorities.


2.10 If an individual (in their capacity of ‘Team Member’) has been registered by a Team Leader, as part of a cohort from the same business/ Organisation, the results of the individual’s final report will also be included (as aggregate results) to the Team Manager’s Team Dashboard. The ‘Team Dashboard’ is an aggregate report of results from all Team Members from the same cohort. In the event a ‘Team’ is made up of a small cohort and the survey responses accumulate sporadically, it is possible that a Team Leader will be able to reasonably attribute aggregate responses to an individual. For the removal of doubt, the Enrolling Manager will not be able to access or review the responses each individual gave to the questions.


2.11 If an individual chooses to share their own data (including but not limited to their Capability Compass Survey) with anyone (including their Team Leader), then that individual accepts full responsibility for the interpretation and use of this data. ADMA is neither responsible nor liable for the way in which the data is used as result of any such disclosure.


2.12 Use of the Capability Compass data within the business which purchased the nominated registration/s is subject to that business’ employment and privacy policies. ADMA is not responsible nor liable for either the policies of any business/ company nor for the use of the information within the employer/ employee relationship.


2.13 While ADMA makes recommendations based on the results generated by the Capability Compass, the User is under no obligations to implement or follow through on any recommendations made.

  • Any ancillary costs associated with participating in the Capability Compass are the responsibility of the User
  • ADMA reserves the right, at any time, to verify the validity of registrations (including a User’s identity, age and place of employment) and to disqualify any User or Enrolling Manager who submits a registration that is not in accordance with these Terms and Conditions or who tampers with the registration process. Errors and omissions will be accepted at the ADMA's discretion. Failure by the ADMA to enforce any of its rights at any stage does not constitute a waiver of those rights.
  • The Capability Compass registration or any unused portion of the registration, is not exchangeable or cannot be redeemed as cash. The Enrolling Manager is advised that tax implications may arise from their registration and they should seek independent financial advice prior to registering.
  • The link to the Capability Compass will be delivered to the User via email to the email address provided by the registrant/ Enrolling Manager at the time of registration. The ADMA is neither responsible nor liable for any late lost or misdirected registration and/or mails (including but not limited to emails).


3. Definitions
ADMA means the Association for Data Driving Marketing & Advertising ABN 53 156 305 487 of Level 27, 100 Barangaroo Ave Sydney 2000;
Employee means any individual who is employed by an Organisation and who uses the Platform under the Organisation’s registration;
Organisation means any entity, company, or employer that registers to use the Platform on behalf of its employees;
Platform means the ADMA Capability Compass tool designed to assess, support, develop and aid upskilling of individuals;
Registration means a paid or otherwise allocated (by ADMA) registration which will provide a User with access to the Platform
User means any individual accessing and using the Platform, including both employees of an organisation and individuals using the Platform for personal purposes. A User can have
multiple ‘roles’ within the Capability Compass (as a ‘Superuser’, ‘ a Team Leader’ and/or ‘Team Member’, Ability to be allocated to more than one role will be determined by ADMA at its complete discretion. Organisations registering individuals will be notified of the rules around role allocation at time of registration;
You or Your refers to either the User or the Organisation, as applicable, depending on the context in which the term is used.


4. License to Use
4.1 These Terms of Use govern the use of the Platform provided by ADMA, including any content, functionality and services offered on the Platform and You agree to be bound by these Terms.


4.2 Subject to these Terms, ADMA grants to each User a limited, non-exclusive, non-transferable and revocable license to access and use the Platform for the Purpose.


5. User and Organisation Obligations
5.1 Individual Users: You agree to provide accurate, up to date information about yourself and use the Platform solely for the Purpose.


5.2 Organisations: You agree to ensure your employees are informed about the Platform’s use, obtain necessary consents from each employee and provide accurate and up to date information about your employees when using the Platform.


6. Data Privacy
6.1 Personal Information (“PI)”) will be collected, used and disclosed in accordance with ADMA’s Privacy Collection Notice and ADMA’s Privacy Policy.


6.2 ADMA collects PI in order to conduct the Capability Compass Assessment and may, for this purpose, disclose such PI to third parties, including but not limited to a User’s Organisation and to agents, contractors, service providers used by ADMA to help deliver the service required. Registration is conditional on providing this PI.


6.3 It is the responsibility of the Organisation registering a User to ensure that they are authorised to provide PI (contact details) provided to ADMA through the registration process. ADMA will be issuing the invitation to participate to each User, using the contact details provided by the Organisation at time of registration. ADMA is not responsible nor liable for any failure of an Organisation to provide the correct contact details.


6.4  If an Organisation is using the Platform, the PI of its employees may be shared with that Organisation pursuant to the Purpose. If You are an Organisation, You are responsible for obtaining explicit consent from each employee before submitting their personal information (including but not limited to work email address) for registration on the Platform. You must inform employees about the nature of the data collected, its use, and the sharing of assessment reports with the Organisation.


6.5 ADMA reserves the right to use aggregated (non-personal) information and data collected through the Platform in future marketing communications, for research and education purposes and to develop the Platform for future iterations.


6.6 Registration and participation in the Platform subscribes the User and Organisation to marketing communications from ADMA (including but not limited to the ADMA newsletter). A User may unsubscribe from receiving these communications, using the unsubscribe facility found in every communication.


7 Intellectual Property Rights
7.1 All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of ADMA or its licensors and are protected by intellectual property laws.


7.2 For Individual Users and Organisations: You may not copy, modify, distribute, sell, or lease any part of the Platform, nor reverse engineer or attempt to extract the source code of any software on the Platform.


8. Data Security and Confidentiality
8.1 ADMA is committed to protecting the privacy and security of all User data and takes reasonable organisation and technical measures to secure the data.


8.2 For Individual Users: You are responsible for maintaining the confidentiality of your login credentials.


8.3 For Organisations: You must ensure that only authorised personnel have access to the Platform and maintain the confidentiality of all login credentials provided.


9. Liability
9.1 The platform and all content and services provided through it are offered on an "as-is" and "as-available" basis. ADMA makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the accuracy, completeness, or reliability of the content provided.


9.2 ADMA is neither responsible nor liable for any action/s taken as a result of any outcome, results, assessments or reports from use of the Platform.
9.3 Users must undertake the Capability Compass within the Platform within the time stipulated. Failure to do so may result in forfeiture of a User’s registration and any monies paid with no obligation on ADMA to provide a credit.


9.4 In the event of unforeseen circumstances (including but not limited to) war, terrorism, state of emergency or disaster ADMA, reserves the right to, subject to reference to all relevant government rules and regulations, to cancel, terminate, modify or suspend access to the Platform.


9.5 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, ADMA (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal
injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the registration, use and outcomes from the Platform, or any technical difficulties of unavailability, unauthorised access or third party interference.


9.6 If the Platform is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of ADMA, ADMA reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the registration for the Platform as appropriate.


9.7 The ADMA is The Australian Computer Society trading as the Association for Data Driven Marketing and Advertising (ABN 53 156 305 487) of Level 27, Tower 1, 100 Barangaroo Ave, Barangaroo, , Sydney, NSW 2000 (ADMA)
