Fax Marketing Industry Standard Released

The Australian Communications and Media Authority released the Fax Marketing Industry Standard and the accompanying Explanatory Memorandum today.

The key conditions of the standard include:
-    the times when marketing faxes cannot be sent
-    information that must be provided on a marketing fax
-    provision of opt-out functionality
-    limiting the number of marketing faxes that can be sent to a number over a particular period.

The standard applies to all participants in the fax marketing industry and to all marketing faxes regardless of whether the marketing fax is being sent to a number on the Do Not Call Register or not. The standard also applies to business, charity, individuals or government entities that are sending marketing faxes.

The Australian Communications and Media Authority has powers under the Do Not Call Register Act 2006 to enforce the Fax Marketing Industry Standard ranging from formal warnings to penalties of up to $250, 000.
