On 1 January 2011 the Trade Practices Act 1974 becomes the Competition and Consumer Act 2010. The new Australian Consumer Law incorporates a national set of consumer protections replacing 17 different national, state and territory legislation.
The new legislation covers important areas for consumer protection including product safety, fair selling practices, unsolicited selling and guarantees on goods and services.
These changes follow other significant amendments to the consumer landscape including the prohibition of unfair contract terms and significant increases in the ACCC’s powers.

Sales practices – A guide for businesses and legal practitioners has been released. This guide explains the new law in simple language and provides practical examples to assist industry in implementing and complying with the new legislation. Companies should also obtain additional assistance to understand the laws and not rely solely on the guides to ensure compliance.

Business has another piece of the Australian Consumer Law puzzle today after the Australian Consumer Law Regulations were released. The regulations significantly change the nature and application of the second tranche of Australian Consumer Law particularly in relation to the unsolicited selling provisions of the Act.
The second tranche of the Australian Consumer Law, including unsolicited selling practice provisions, come into effect on 1 January 2011. Business is encouraged to ensure that it understands and implements these changes.

The Treasury on behalf of SCOCA have requested public comment on draft regulations for the second tranche of Australian Consumer Law. The second tranche of Australian Consumer Law introduces major reforms and changes to unsolicited selling, consumer guarantees and product safety.

The second tranche of Australian Consumer Law was passed on 24 June 2010. The bill will make significant changes to the Trade Practices Act, including renaming it the Australian Consumer and Competition Act. The passage of the second tranche clears the way for the creation of a single consumer code that will replace 17 different and sometimes conflicting pieces of legislation.
The bill will also usher in new arrangements for unsolicited sales, both by telephone and door to door selling.

ADMA has provided a submission to the Senate Economics Committee's Inquiry into the Trade Practices Amendment (Australian Consumer Law) Bill No. 2 2010. The Senate Committee is conducting an inquiry into the Bill that, if fully implemented, will replace 17 different State and Territory fair trading laws.
